Background

Proposition 64, which was approved by the voters in 2016, legalized recreational cannabis in California. Proposition 64 allows anyone 21 years of age or older to buy, consume, and receive cannabis up to certain limits and grow up to six live plants inside their personal residence or in a secure backyard greenhouse. Because Proposition 64 is a State Law, American Canyon does not have any authority to prohibit these activities.

Proposition 64 allows local jurisdictions to decide whether to allow commercial cannabis businesses in our community. After a nearly 2-year process with numerous public meetings and outreach, the City Council adopted a Cannabis Ordinance in September 2018. This ordinance may allow six (6) commercial cannabis business permits following compliance with stringent requirements and a public hearing in the Green Island Industrial Zoning District. These businesses may include indoor nurseries, manufacturing, testing, non-storefront retail and home delivery services. The Ordinance does not allow residents to grow cannabis outdoors at their personal residence. Retail storefront cannabis stores are also not allowed.
